Terms of Service

By using the nethunt.com website ("Site"), NetHunt CRM Google Chrome extension, iOS and Android OS mobile applications or any services of NetHunt ("Services"), you ("You") agree to be bound by the following Terms of Service ("Terms"). The following Terms can be modified by NetHunt at any time at its discretion by updating the Terms on this web page, without prior notice.

The revised Terms shall become effective immediately after the modifications are posted to the Site. By continuing to use NetHunt Services or Site you automatically express your consent to the updated Terms.


You must agree to and accept all of the Terms, or you don’t have the right to use the Services. By using the Services, you agree to all of these Terms, and the Terms will remain in effect while you use the Services. Violation of any of the Terms results in the termination of your account. These Terms include the provisions in this document, as well as those in the Privacy Policy. General Scope

By accessing or using the Services you agree to be bound by these Terms. If you are using the Services on behalf of an organisation or entity ("Organisation"), then you are agreeing to these Terms on behalf of that Organisation and you warrant that you have the authority to bind the Organisation to these Terms. In that case, "You" and "Your" refers to you and that Organisation.


The Services may change from time to time as we evolve, improve or add more features to the Services, often without prior notice to you. NetHunt may temporarily or permanently stop providing the Services, or any features within the Services, to you or to users in general and may not be able to provide you with prior notice.

Access and Restrictions

All content included on this Website and inside the Services, such as text, graphics, logos, button icons, images, digital downloads, and software, is the sole property of NetHunt or its content suppliers and protected by international copyright laws.


You shall not display, reproduce, duplicate, create derivative works from, rent, distribute, perform, publish, copy, lease, transfer, assign, modify, sublicense, sell, resell or otherwise commercially exploit or make the Services available to any third party. You will comply with these Terms, and any codes of conduct, policies or other notices NetHunt provides you or publishes in connection with the Services.

Account Terms

Only human users are permitted to create Services accounts. Accounts registered by bots and other automated methods are not permitted and will be deleted.


NetHunt may communicate with you via email regarding your account, updates, news, and other issues related to your account. By registering with NetHunt you automatically get subscribed to our mailing lists and newsletters and agree to receive promotional NetHunt-related material. You can choose to opt out from receiving emails at any moment.


You are responsible for maintaining the security of your account and password. NetHunt cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.


You are responsible for all content posted and all activity that happens under your account.


NetHunt imposes no restrictions on how many Folders, Follow-Ups, Records and other CRM entities the user can create under their account. However, in case we detect an unusual volume of activity within a single account that is unlikely to be produce by a human user, we reserve the right to temporary suspend that account and contact its owner to seek cooperation in regard of resolving such situation.


NetHunt reserves the rights to accept or refuse to any potential client. We have the sole discretion on whether to allow you to register, renew, change plan, or use our services.

Payments

Except with respect to any “free trial” of the Services, you will be required to select a payment plan and provide NetHunt with the information regarding your credit card or other payment details requested by NetHunt. You represent and warrant to NetHunt that such information is, and will be maintained as true, complete, accurate, and up to date, and that you are authorized to use such payment instrument. You agree to pay and hereby authorize NetHunt to bill your payment instrument in advance on a periodic basis in accordance with the terms of the applicable payment plan until you terminate your account in accordance with these Terms. All charges are final, non-cancelable, and nonrefundable, provided that if NetHunt terminates your account on the Service without cause, you will be entitled to a pro-rated refund of prepaid amounts. All fees may be changed by NetHunt at any time and you will be notified about such changes. The changes will become applicable in the following billing cycle (or any other time specified by NetHunt). NetHunt reserves the right to charge fees for features of the Services that were previously free. Unpaid free trial use of the Services may be subject to limitations, as may be described in our documentation or otherwise on the Site.


Unless you notify NetHunt before the end of the applicable subscription period that you want to cancel your subscription, your subscription will automatically be renewed. This way you authorize us to collect the then-applicable annual or monthly subscription fee for your current subscription plan using any credit card or other payment mechanism we have associated with you. Subscription can be canceled via the corresponding option in the Services’ settings or by contacting our support team at support@nethunt.com.

Data Ownership

NetHunt respects your right to ownership of content created or stored by you (“Content”). You are the owner of such Content. Unless specifically permitted by you, your use of the Services does not grant NetHunt the license to use, reproduce, adapt, modify, publish or distribute the Content created by you or stored in your user account for NetHunt’s commercial, marketing or any similar purpose. But you grant NetHunt permission to access, copy, distribute, store, transmit, and reformat the content of your user account solely as required for the purpose of providing the Services to you.

Data Management and Retention

To ensure effective data management and uphold our service quality, NetHunt has instituted specific policies regarding the deletion of user data within our Services.


Workspaces DeletionIn order to manage our digital environment efficiently, NetHunt will delete any workspace that has been locked, three (3) months after the date it was locked. This action is taken irrespective of the cause for the workspace being locked, whether due to failed payment or an expired trial period. This policy is in place to maintain optimal performance and security standards for our Services, while also helping us manage data more effectively.


Deletion of CRM Folders and RecordsAligning with our commitment to a streamlined and efficient user experience, CRM folders and records that are moved to the Trash by a user will be automatically and permanently deleted after a period of thirty (30) days. We urge our users to be certain about their decision to move data to the Trash, as this action is irreversible and will result in the permanent removal of that data after the 30-day window.


Your continued use of our Services signifies your understanding and agreement to these data management and retention policies. These policies are vital for the seamless operation of NetHunt and aim to enhance the effectiveness and security of your interactions with our platform.

Content within the Services and Site

Some areas of the Services and Site may allow you to post or upload information, text, graphics, or other material. Some of your Content may be viewable by other users when shared and/or used in a collaborative fashion. You retain ownership of that Content, but other users may have access to that Content and, for example, copy, modify, re-share, or broadcast it. NetHunt is not responsible for such activity.


Pay attention that as you invite other users to join your team in a shared NetHunt workspace, they will automatically get access to the email correspondence linked to the records in the shared folders. You may update user roles and permissions in order to limit other users’ access to specific folders, yet if you share a folder with other users, all information in the records (emails, notes, clients etc.) will be accessible by your teammates.


When you are invited to NetHunt CRM, some of your emails may fall within the filters in the shared workspace. Filters are created to automatically link particular incoming and sent emails to the corresponding records for better data organization. Therefore, your emails may be linked to the records accessible by other users. This may include your business and personal correspondence from the inbox used to access NetHunt if these emails meet filter requirements.


You agree not to post/share or otherwise collaborate on Content that:

  • May create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person.
  • May constitute or contribute to a crime or tort.
  • Contains any information or content that is illegal.
  • Contains any information or content that you do not have a right to make available under any law.
  • Contains any information or content that may be deemed to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people, libellous, threatening or otherwise objectionable.

Cancellation and Termination

You are solely responsible for properly canceling your account. All of your Content will be immediately deleted from the Services after cancellation. This information can not be recovered. All service charges accrued up until the cancellation date must be paid in full. NetHunt, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Services for any reason at any time. Such termination of the Services will result in the deactivation or deletion of your Account or access to your Account, and the forfeiture and relinquishment of all Content in your Account.

Limitation of Liability

You agree that NetHunt shall, in no event, be liable for any consequential, incidental, indirect, special, punitive, or other loss or damage whatsoever or for loss of business profits, business interruption, computer failure, loss of business information, or other loss arising out of or caused by your use of or inability to use the service, even if NetHunt has been advised of the possibility of such damage. In no event shall NetHunt’s entire liability to you in respect of any Service, whether direct or indirect, exceed the fees paid by you towards such service.

Indemnification

You agree to defend, indemnify and hold harmless NetHunt and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses (actual and potential), liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from your use of and access to the Services, including any data or Content transmitted or received by you, any other party’s access or use of the Services within your Account, or your violation of these Terms, applicable law, rule or regulation.

Warranty

You expressly understand and agree that the use of the services is at your sole risk. The services are provided on an “as is” and “as available” basis. NetHunt expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. NetHunt makes no warranty that the Services will be uninterrupted, secure, timely or free of error. Use of any material downloaded or obtained through the use of the Services shall be at your own discretion and risk and you will be solely responsible for any damage to your computer system, smartphone, wireless device or data that results from the use of the services or the download of any such material. No advice or information, whether written or oral, obtained by you from NetHunt, its employees or representatives shall create any warranty not expressly stated in the Terms.

The Privacy Policy governs NetHunt's use of personal information and is incorporated herein by reference. We recommend you to read it prior using NetHunt Services or Site.
